Any quotation, written estimate, or proposal is based on the information available at the time it is issued. If site conditions change, if access is restricted, or if additional work becomes necessary, the scope and price may need to be revised before the work proceeds.

Booking process

A booking may be made after an initial enquiry and, where necessary, a site assessment. Payments

Unless otherwise agreed in writing, invoices are due for payment upon completion of the work. For larger projects, a deposit, staged payment, or part payment may be requested in advance, particularly where equipment hire, waste disposal, or specialist labour is required. Any deposit will be confirmed before the booking is finalised. The final invoice may reflect agreed variations, additional labour, extra waste handling, or work that became necessary because of hidden defects or unforeseen site conditions.

All quoted prices are based on the information supplied at the time of quotation and are subject to change if the scope changes. Examples include additional climbing, prolonged dismantling, emergency access arrangements, traffic management, or extra removal of timber, branches, roots, or green waste. Where extra charges arise, we will explain the reason before or as soon as reasonably practicable after the work is completed. The customer remains responsible for all agreed sums, even if payment is delayed by a third party unless we have expressly agreed otherwise.

We reserve the right to charge interest or recover reasonable costs on overdue sums in accordance with applicable law. If payment is not received when due, we may suspend further work, withhold the transfer of materials, or pursue recovery through lawful means. Title to any materials or products supplied may remain with us until payment is made in full, to the extent permitted by law.

Cancellations and postponements

If the customer wishes to cancel or reschedule, notice should be given as early as possible. Where a booking has been reserved specifically for the customer, and we have allocated time, labour, or equipment, short-notice cancellation may result in a charge to cover wasted costs. The amount of any cancellation fee will depend on the timing of the cancellation, the nature of the work, and any expenses already incurred. Any deposit paid may be retained in part or in full where reasonable to do so.

We may also cancel or postpone work where circumstances make the job unsafe, unlawful, or impractical. This includes, but is not limited to, extreme weather, suspected disease or structural instability, the presence of nesting birds or protected wildlife, unsafe electricity lines, lack of access, or the absence of required permissions. In such cases, we will aim to rearrange the service within a reasonable time. We will not be liable for consequential loss caused by delay where the delay is outside our reasonable control.

If the customer is not present and has not arranged suitable access or instructions, we may treat the booking as cancelled on arrival and charge for time, travel, and other reasonable costs incurred. Any postponement requested by the customer is subject to our availability. Repeated changes may affect pricing, particularly if crew or equipment must be reallocated. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other matter that cannot legally be excluded. Subject to that, our liability is limited to direct losses that are reasonably foreseeable and caused by our proven breach of contract or negligence. We do not accept liability for indirect, incidental, or consequential losses, including loss of profit, loss of business, loss of enjoyment, or third-party claims arising from matters beyond our control.

We are not liable for damage resulting from: defective or unstable trees, hidden rot, concealed services, pre-existing structural weakness, incorrect information supplied by the customer, or the customer’s failure to secure pets, vehicles, furniture, ornaments, or other valuable items. The customer should remove or protect items that could be affected by debris, access equipment, wood chippings, or falling material. If the customer asks us to work in a confined area, the risk of minor scuffing or disturbance may be higher.

If a claim arises, the customer must notify us promptly and give us a reasonable opportunity to inspect the issue before remedial work is undertaken by others. We may choose to inspect, repair, replace, or compensate at our discretion where a valid claim is established. Any claim must be brought within a reasonable time and, in any event, within the period allowed by law. The customer’s statutory rights are not affected by these terms.

We handle waste in accordance with applicable waste management and environmental requirements. Where we remove material from site, it will normally be transported to an authorised facility or recycled in a lawful manner. The customer should not assume that all waste will be removed unless this is expressly included in the quotation.

Where waste removal is included, the quotation may specify whether logs, timber, or woodchip will be left for the customer, chipped on site, or taken away. If the customer requests retention of certain materials, this must be agreed in advance. We reserve the right to decline removal of contaminated, hazardous, or otherwise unsuitable waste unless separate arrangements are made. The customer must disclose any known contamination, disease, or treated materials before work starts.

We will take reasonable steps to avoid unnecessary damage to lawns, borders, or access routes when removing waste, but wheelbarrows, chippers, and loading equipment may leave marks on soft ground. If access is poor, the customer may need to provide temporary protection or suitable hardstanding. Any request for additional clearance, haulage, or tipping arrangements may incur extra charges. Waste transfer notes or related records may be retained where legally required.

Health, safety, permits, and legal compliance

Tree surgery involves chainsaws, climbing systems, cutting tools, lifting equipment, and potentially heavy loads. We will operate in accordance with health and safety duties and may stop work if the environment is not safe. The customer must keep unauthorised persons, children, and animals away from the working area. If necessary, we may establish exclusion zones and ask the customer to respect them. Any interference with safety controls may lead to immediate suspension of the work.

Some work may require permission, notices, or checks for planning controls, conservation restrictions, tree preservation orders, or landlord consent. The customer is responsible for confirming whether such permissions are needed unless we have expressly agreed in writing to obtain them on the customer’s behalf. Where legal approval is required and has not been obtained, we may postpone or cancel the work without liability for resulting delay. The customer should ensure that the work requested is lawful before instructing us to proceed.

We may rely on subcontractors or specialist partners where appropriate, provided the overall service remains managed to a professional standard. Any such party will be required to comply with relevant safety and legal obligations. The customer agrees not to instruct our team to ignore safe procedures, to work beyond the agreed scope, or to carry out unlawful activities. Tree surgeon services are delivered with a priority on safety, compliance, and responsible management of arboricultural risks.

Force majeure

We are not responsible for failure or delay caused by events outside our reasonable control. These may include severe weather, storms, flooding, fire, labour disputes, equipment failure not due to our negligence, transport disruption, power outages, acts of public authority, or emergency conditions affecting the site. If such an event occurs, we will use reasonable efforts to resume or reschedule the work, but we will not be liable for resulting losses beyond any refund or adjustment required by law.

Variations, ownership of materials, and customer property

Any change to the agreed scope must be confirmed before the additional work is carried out where reasonably practicable. Variations may affect price and timing. Unless agreed otherwise, timber, branches, stump grindings, and other arisings removed from site become our responsibility once taken away. Items left for the customer remain the customer’s property and should be stored or used promptly to avoid deterioration. We are not responsible for the loss of items left unattended on site after completion.

Complaints, severability, and entire agreement

If the customer is dissatisfied with any aspect of the service, they should raise the issue promptly so that we may investigate and, where appropriate, resolve it. Failure to notify us in a reasonable time may make it harder to assess the issue fairly. If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue in force. Any waiver of rights must be in writing and will not apply to future situations unless expressly stated.

These terms, together with the quotation or written job specification, form the entire agreement between the parties in relation to the service provided. The customer confirms that they have not relied on any statement or representation that is not included in this agreement. No person who is not a party to the agreement shall have any right to enforce its terms under the Contracts (Rights of Third Parties) Act 1999 unless expressly stated otherwise.

Governing law
These terms and any dispute or claim arising from them shall be governed by and construed in accordance with the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales. These Terms and Conditions are intended to create a fair and practical framework for tree surgery services, ensuring that both the customer and the service provider understand their rights and responsibilities from booking through to completion.
